Terms and Conditions

1. The Services

Created.ai is a platform for creating, editing, and publishing advertising content using artificial intelligence, including image, video, audio, and text generation, and for publishing and analyzing advertising campaigns through connected third-party accounts (such as Meta). We may add, change, or remove features at any time.

2. Eligibility and Accounts

• You must be at least 18 years old and use the Services on behalf of a business or in a professional capacity.
• You are responsible for your account credentials and for all activity under your account, including activity of workspace members you invite.
• You must provide accurate registration information and keep it up to date. We may suspend or terminate accounts created with false information.

3. Subscriptions, Tokens, and Billing

• Plans: Access to the Services requires a paid subscription. Plans renew automatically at the end of each billing period (monthly or annual) until cancelled.
• Tokens: Generation features consume tokens. Each plan includes a monthly token allowance; additional token packs can be purchased. Plan tokens reset at each billing period and do not roll over; purchased token packs do not expire while your subscription is active.
• Payments: Payments are processed by Stripe. By subscribing you authorize recurring charges to your payment method.
• Cancellation: You may cancel at any time via the billing portal. Cancellation takes effect at the end of the current billing period; you keep access until then. Except where required by law, fees, including token pack purchases, are non-refundable.
• Price Changes: We may change plan pricing with prior notice; changes apply from your next billing period.

4. Your Content

• You retain all rights to the images, videos, copy, and other materials you upload ("Your Content"). You grant us a limited license to host, process, and display Your Content solely to provide the Services.
• You are responsible for Your Content and must have all rights necessary to use it, including rights to any people, brands, or trademarks it depicts.
• We do not use Your Content or your private ad performance data to train generalized machine learning models for other users.

5. AI-Generated Content

• Subject to these Terms and payment of applicable fees, you own the content you generate with the Services ("Generated Content") to the maximum extent permitted by law.
• AI output can be inaccurate or similar to output generated for others. You are responsible for reviewing Generated Content before use and for ensuring your use of it complies with applicable laws and advertising standards.
• Generated Content that includes stock or licensed elements (for example, avatars or voices from our libraries) may be subject to additional license terms shown in the product.

6. Acceptable Use

You must not use the Services to:

• create or distribute unlawful, deceptive, defamatory, or infringing content;
• generate content that impersonates real people without their consent, or misleading "deepfake" material;
• violate advertising policies of the platforms you publish to, including Meta;
• probe, disrupt, reverse engineer, or overload the Services, or access them by automated means outside documented interfaces;
• resell or sublicense the Services without our written consent.

We may remove content or suspend accounts that violate this section.

7. Third-Party Services

The Services integrate with third-party platforms such as Meta, Google, and Stripe. Your use of those platforms is governed by their own terms and policies, and we are not responsible for their availability or actions. Connecting a third-party account authorizes us to access it as described in our Privacy Policy.

8. Intellectual Property

The Services, including software, design, and branding, are owned by ContentCreator Ai, LLC and its licensors and are protected by intellectual property laws. Except for the rights expressly granted in these Terms, no rights in the Services are transferred to you.

9. Disclaimers

The Services are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that Generated Content will achieve any particular advertising result.

10. Limitation of Liability

To the maximum extent permitted by law, ContentCreator Ai, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from or related to the Services. Our total aggregate liability for all claims in any 12-month period will not exceed the amounts you paid us for the Services during that period.

11. Indemnification

You will indemnify and hold harmless ContentCreator Ai, LLC from claims arising out of Your Content, your use of Generated Content, or your breach of these Terms.

12. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access for breach of these Terms, non-payment, or unlawful use. Sections that by their nature should survive termination (including 4, 5, 8, 9, 10, and 11) survive.

13. Changes to These Terms

We may update these Terms from time to time. For material changes we will notify you by email or in the product before the changes take effect. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Orange County, California, and you consent to their jurisdiction.
